Get to Know Me:

I believe a diplomatic but firm approach to debtors from the outset ensures an improved chance of recovery for my client which is of course of paramount importance.

I primarily deal with commercial debts and outstanding invoices on trade accounts.  Because the majority of the debts I deal with are “business to business debts” I will ensure that any claim includes the relevant interest and where applicable Late Payment Compensation that you are entitled to claim from the debtor in addition to your outstanding debt.

Going to Court should always be a last resort.  At the pre-issue stage, wherever possible, it is essential to try to negotiate a solution.  By providing me with clear documentation and information from the outset, I can attempt to negotiate with the debtor to bring about full payment or a settlement to avoid the expense of court proceedings.  If such pre-issue action is not undertaken, this can often count against you later if you don’t attempt reasonable steps to settle before proceeding through the Court.

However, settlement is not always possible and therefore from sending an initial Letter before Action to issuing Court proceedings for recovery, to obtaining Judgment and enforcing it,  I look to obtain Judgment as soon as possible for my clients, whether it is by default Judgment, or by an application for Summary Judgment to avoid a final hearing.

At any stage in proceedings I can make an offer to the other party to settle the dispute. If such an offer is not accepted by the debtor, by making such an offer “without prejudice”, it cannot be used against you later in court.

Once Judgment is obtained I review enforcement options with you to decide the most appropriate enforcement type for each debt, whether it be instructing County Court bailiffs or High Court Enforcement Officers, to obtaining a Charging Order against a debtor’s property, an Attachment of Earnings Order if your debtor is employed to a Third Party Debt Order to freeze monies held in their bank account.

If I cannot settle a commercial dispute or it becomes defended, I will review your case fully with you so that you have all the information to decide whether it cost effective to continue with your claim.  If you do not have a strong case and evidence to back up your claim, proceeding can be both uncertain and costly. 

However, my aim is to bring about swift recovery of a debt in a cost effective manner.
