Dismissals (Unfair, Constructive, Wrongful)

There are 5 potentially fair reasons for which an employer can dismiss an employee. If an employee is dismissed for any other reason the dismissal will be unfair and they will have the right to bring a claim in the employment tribunal. Equally if the correct procedures are not followed a dismissal may be unfair despite being for one of the 5 potentially fair reasons. In certain circumstances an employee may be considered to be ‘dismissed’ by his employer even when he resigns from his position.
