Powers of Attorney

You have the ability to legally authorise people you trust to act on your behalf if you become physically frail or mentally incapable of managing your own affairs. We can help you appoint your chosen attorneys to act on your behalf should the need arise.

A Lasting Power of Attorney is a legal document which enables you to appoint a person or persons of your choice to act on your behalf. They are called Lasting Powers of Attorney because they remain valid if you subsequently lose mental capacity.

You can appoint Property & Financial Affairs attorneys to deal with your financial affairs ranging from dealing with the payment of day to day living costs to managing investments and business interests to the sale of property.

You can appoint Health & Care attorneys to make decisions relating to your health and welfare which may range from care needs and living arrangements to making medical decisions including the refusal of life sustaining treatment

The Mental Capacity Act 2005 sets out the framework under which your attorneys must act and the core principles note that the attorneys must always act in your best interests.

Lasting Powers of Attorney have no effect until they have been registered with the Court of Protection. We can also assist with the registration of existing Enduring Powers of Attorney should the person giving the power lose mental capacity.

In some circumstances experienced members of our team can act as attorneys if you are vulnerable and do not have anyone available to assist you. We work with family, carers and social services to ensure that our assistance is in your best interests.

If you no longer have the required mental capacity to choose your own attorney we can assist your loved ones to apply to the Court of Protection for a Deputyship Order.
