We can also make applications to the Court of Protection for a Deputyship Order when a person lacks the capacity to choose an attorney.
The Court of Protection grants deputyship orders to appoint someone to manage the affairs of a person who lacks capacity.
The Court decides what decisions the Deputy may make. These include day-to-day financial management and the sale of someone’s property and investments. The Court determines which level of supervision. This can be a light approach or a far more onerous level of supervision. In most cases the Deputy will have to make an annual financial report.
